TEAM cycles Ltd

1. TEAM cycles LTD, ​a limited company registered in England and Wales, Registered No. 7825622 Terms and Conditions are set out below. We prefer to work with our clients in an amicable and mutually beneficial way, so please advise us of any circumstances potentially affecting our delivery or the terms set out here as early as possible. No set of Terms and Conditions is perfect for all situations. TEAM cycles Ltd may be referred to as TEAMcycles.

2. This document covers services and goods provided by TEAM cycles Ltd, if there is anything not clear, or not covered, please contact us for clarification. E&OE.

3. Payment terms are latest 30 days from the first day of a delivery (services) and the “pay by” or “due by” date will be shown on the invoice. New customers may be required to settle earlier, or before delivery.

4. Late payments may incur a charge of £40.00 to £100 (depending on the debt) plus interest may be charged on the overdue amount in line with “The Late Payment of Commercial Debts (Regulations) 2013”. Any discounts applied may, at our discretion, be removed from any invoice re-issued due to late payment.

5. We prefer payments by BACS or CHAPS or other electronic method. If you prefer to pay by cheque, you must add £6.00 to each cheque to cover bank charges. Credit Card payments are not accepted.

6. For new Services customers we may require full payment in advance, on receipt of a Pro Forma Invoice. Or, we may require a 50% payment to be received not later than 1 month before the event start date.

7. Payment for Goods is normally due at the time of order placement, unless otherwise agreed in writing, a Pro Forma Invoice will be sent to you for higher value goods

8. Payments for Goods and services shall only be accepted in Pounds Sterling. Unless otherwise agreed in writing any payment received from you in any other currency will not be deemed to be payment for the Goods in question.

9. Cancellations must be made in writing to TEAM cycles Ltd.

10. In the event of a cancellation the following charges may apply:
Within 30 days prior to confirmed event/delivery of services – 25% of total
Within 7 days prior to confirmed event/delivery of services – 50% of total
Within 48hrs of confirmed event/delivery of services – 75% of total
Within 24hrs of confirmed event/delivery of services -100% of total

11. The percentages listed above refer to the total price of the ‘package’. We recommend that insurance to cover cancellation is arranged for higher value events/services.

12. Events: In the event of traffic, or other circumstances outside our control, preventing us from being able to fulfil our obligations our liability shall be limited to a pro-rata reduction in the fee in the event of delayed start. No further compensation will be paid.

13. Goods: delivery dates noted on the Quote/Pro Forma are subject to change through mutual agreement. TEAM cycles are not liable for delays due to circumstances outside our control.

14. Ownership of goods transfers to you on completion of delivery to you and payment to us

15. An administration charge of 10% of the total cost may be made in respect of a significant alteration or change in event booking details. The definition of ‘significant’ is that of TEAMcycles at the time, taking into account circumstances.

16. Any cheques returned not cleared by our bankers will be subject to a £40.00 charge.

17. The Company reserves the right to cancel, alter, or delay any booking where forced to do so by circumstances beyond our control, such as serious illness, severe weather or any other circumstances which, in the opinion of the TEAM cycles Ltdon the day, would subject TEAM cycles Ltd or any of its employees or any participants to danger.

18. The company reserves the right to substitute hired equipment with equipment of a similar type and value in the event of previous damage or loss of booked equipment.

19. All equipment supplied as part of an event remains the property of TEAMcycles.

20. Events: TEAM cycles reserve the right to send away any person who in their judgement is found to be unmanageable or a danger to the safety or enjoyment of others, or under the influence of alcohol or drugs. In this event no refund will be given. Any additional costs and responsibility involved in removing the participant will be borne by the client.

21. Participants must be physically fit to take part in the activities involved and free from any illness or conditions that may render the activity hazardous. Certain activities are only suitable for specific age groups and these age restrictions must be adhered to. TEAM cycles accepts no responsibility when clients fail to adhere to these guidelines.

22. Some activities are potentially dangerous if not properly managed. Safety must therefore be paramount and all participants must accept that the decision of the activity instructor is final and at all times be accepted by the participants. TEAMcycles will accept no liability for problems arising from failure to accept and/or respond to the authority and instructions of the appointed staff.

23. Any and all photographs, videos, or other recorded media may be used by TEAMcycles for the purposes of marketing or advertising without any payment or compensation being offered and without any request being made to the featured parties, unless otherwise agreed in advance in writing.

24. Equipment, once sited, will not be moved. Please ensure that you advise our staff where you want them to set-up accurately.

25. The get-in time as stated on your documentation is the time that we can access an event and start setting up equipment.

26. The get-out time as stated on your documentation is the time that we can access an event and start breaking down equipment.

27. Alterations to booking times, including collection times, made on the day of an event, may be subject to a £50 charge and then an hourly rate charged for each extra hour or part thereof. The hourly rate will be calculated pro rata and will depend upon the location and time of the delay. The hourly rate will be not less than the booked activity rate.

28. No Liability is accepted for:
• Loss of or damage to property belonging to or travelling with the members of any group. For example watches, jewellery, cameras or clothing
• Losses or additional expenses due to delays or changes in travel services, sickness, weather, strikes, riots, war, quarantine or any other cause.
• Personal injury or death of any participants however caused unless by proven negligence of TEAM cycles.

29. In the event of any damages caused by participants to property or equipment in use by TEAM cycles, except by fair wear and tear, the client will be charged the full replacement cost.

30. Any damages must be reported to a member of TEAMcycles staff, or the TEAMcycles contact immediately.

31. All information given in any literature produced by or on behalf of TEAMcycles is given in good faith and is intended as a guide to services available and may be altered without notice to suit differing seasonal or other operational conditions. All information is correct at time of printing.

32. If you have any complaint during your booking, please notify the TEAMcycles representative immediately. We will then do our utmost to find a speedy and satisfactory solution. In the event that you are not satisfied with the solution please complain in writing to the Owner of TEAM cycles within 14 days of the end of your booking.

33. For the comfort, health and safety of all concerned, there will be no smoking during any of the activities.

34. TEAM cycles is covered by all necessary insurances.

35. TEAM cycles staff are First Aid trained, but please advise our staff of the First Aid procedures for your own event/venue/location.

36. Goods/services: Guarantee – The Equipment supplied and the services carried out by TEAM cycles are covered by the following express guarantee:
(a) TEAM cycles takes all precautions to ensure the quality of materials and workmanship in respect of all Equipment and services against faulty material and/or workmanship in respect of all Equipment and services: for a period of twelve months from the date of delivery.
(b) TEAM cycles will in no circumstances accept responsibility for any defects whatsoever arising from misuse of any Equipment or arising out of situations outside the control of TEAM cycles.
(c) This Guarantee shall not apply to defects in any Equipment which has been altered by The Client or third parties and any claims hereunder must be made within 30 days of the discovery of the defect.
(d) Equipment is tested before loading, however the process of transporting equipment can occasionally lead to operation issues, which cannot be predicted. We strongly recommend testing the equipment after delivery to allow enough time for any repair/replacement. We will assume that all equipment is functioning satisfactorily if we are not advised within 6 hours of delivery

37. We understand and will exercise our statutory right to claim interest and compensation for debt recovery costs under late payment legislation if we are not paid according to agreed credit terms.

38. Images used on this website are copyright either of TEAMcycles or our partners and/or clients. Permission has been sought and given to TEAMcycles to use images. No third party shall use images from this website without the express agreement of TEAMcycles and/or the original copyright holder.

39. English Law Jurisdiction of the English courts

40. The only language offered by us for any contract is English.
